1.0 INTRODUCTION
The Progeny realm is striving toward achieving an improved sustained quality of life for its current and future generations, to that end the office of the Devil's Advocate is embarking on supporting an 'institutional legal system' to better enable the integration of the sectoral development of policies and plans already in use throughout the Progeny realm.
This 'Terms of Reference' document outlines the roles of both the Chief Devil’s Advocate (CDA) (Legal Advisory Administrator) and the Devil’s Advocate (DA) (Legal Advisory Officer).
This document also contains a summary of all relevant documentation contained at the Progeny Scribes Guild regarding the legal precedents and Laws within the per-view of the Office of the Devil's Advocate and indeed the 'institutional legal system'.
2.0 NOTICE/IMPORTANT INFORMATION
- At this time what is termed as the 'institutional legal system' are the Rules and Laws pertaining to the Progeny community ranks, Sovereign and below, i.e. all vampires excluding the Arch Vampires (Arch Conclave) will be subject to this legal system.
- The Devil's Advocate office will serve to interpret and place arguments before the Arch Judiciary on behalf of those who are making a case against an individual or group within the Progeny realm. The Devil's Advocates are not Judges, they are Advocates for the accused and accusers.
- To be clear the Diabolic Council (Decisions made as a body), individual acts of a Diabolic, the Arch Conclave (Decisions made as a body) or individual acts of an Arch Vampire, DO NOT fall under the purview of the Office of the Devil’s Advocate and may not come before the Arch Court (Arch Judiciary). Any cases one might have against an individual Diabolic or Arch Vampire, or decisions made by the Arch Conclave or Diabolic Council must be submitted through the existing channels which will be listed in full at the end of this document.
- It is also understood by the acceptance of this documentation by the Arch Conclave, the Diabolic Council, the Clan Sovereignty and The House Princeps (Renegade, Rogue or GCSC) that from this time the Progeny realm is subject to this 'institutional legal system' as of the date of its' acceptance and that the documentation indicated in sections 'COURT JURISDICTION AND APPLICABLE LAW', 'LAWS', 'JUDICIAL PROCEDURE' and 'TERMS OF REFERENCE' will be the 'primary' sources from which the office of the Arch Judiciary and Devil's Advocate will operate.
- Historical determinations by any level of Progeny that could be used as legal argument or precedent, will be allowed on a case-by-case basis, depending on the source of the judgement and its relevance to the situation at hand. In most situations going forward the documentation as indicated ('JURISDICTION AND APPLICABLE LAW' and 'LAWS') sections will be the primary legal guidelines.
- An important aspect to understand is that a Renegade individual(s) can make a case against a GCSC Aligned individual(s) and vice versa and these cases will still be brought before the Judiciary for judgement. More on the workings of this inter-affiliation classification will be added in the 'JURISDICTION AND APPLICABLE LAW' section.

5.0 ARCH JUDICIARY
The Progeny Institutional Legal System will have a Judiciary chosen from amongst the Arch Conclave with Arch RachelC as the first Chief Justice. The Chief Justice will occupy the position of Trial Judge and will appoint associate judiciary as required from amongst the Arch Conclave.

7.0 JURISDICTION AND APPLICABLE LAW
At the moment each section of the Progeny community is subject to disparate rules and laws governing their conduct. The consequence of this is that not all cases are judged according to a uniform code of justice. This makes the process of creating cases against certain members of our community more difficult in certain situations.
To clarify the laws that are applicable to each section of our society we have grouped them into 'GCSC Aligned' and 'NON-GCSC Aligned'.
To simplify the categorisation of the groups for example, under the 'GCSC Aligned' category we have grouped Houses under a certain Clan-type as being of that "same" type, i.e. a Dissident Clan has Dissident Houses and are all GCSC Aligned, whilst a Rogue House is by definition NON-GCSC Aligned, regardless of whether they do in fact choose to follow the GCSC law.
This is not always the case as an Arch affiliated Clan may have a Political Renegade House for example, which is tolerated and allowed by the Clan Sovereign. By Diabolic ruling no matter what internal governing structure a Clan Sovereign may choose to organise the Houses under their Sovereignty, the primary position of the Clan will be the measure of which the Houses will be tested.
Be aware that if you lodge a case at the office of the Devil's Advocate, the first step will be to determine the Clan and House affiliations in beginning to evaluate the matter. If the matter proceeds to the stage of contacting the accused party then they will also have to provide this information. This initial information will allow the DA assigned to the case to determine under what law the matter will proceed.

Claims against an Infernal for abuse of power not in the course of their assigned duty should be directed to their Diabolic Patron (see section 9.0)

Though an extension of a Diabolic’s will, they remain nonetheless a vampire and within the fold of the community. Their service stands so long as necessity for their service is warranted.
It should also be noted that in accepting an offer by a Diabolic to become one of their Infernals, the individual, while being previously noted as an extension of the Diabolic, must be mindful of the fact that they, from then on, carry and reflect the reputation of both themself and their Patron.
7.3f) CHIEF DEVILS ADVOCATE/DEVILS ADVACATE

1.0 INTRODUCCIÓN
El reino de Progeny se esfuerza por lograr una mejor calidad de vida sostenida para sus generaciones actuales y futuras, con ese fin, la oficina del Devil´s Advocate se embarca en apoyar un 'sistema legal institucional' para permitir una mejor integración del desarrollo sectorial de políticas y planes actualmente en uso en todo el reino de Progeny.
Este documento de "Términos de referencia" describe los roles del Abogado General del Devil´s Advocate (AGD) (Administrador de Asesoría Legal) y de los Abogados asesores de la oficina del Devil´s Advocate(DA) (Oficial de Asesoría Legal).
Este documento también contiene un resumen de toda la documentación relevante contenida en el Gremio de Escribas de Progeny con respecto a los precedentes legales y las Leyes dentro de la perspectiva de la Oficina del Devil´s Advocate y, de hecho, el 'sistema legal institucional'.
2.0 AVISO / INFORMACIÓN IMPORTANTE
- En este momento, lo que se denomina el “sistema legal institucional son las Reglas y Leyes pertenecientes a los rangos de la comunidad de Progeny, Soberanos e inferiores, es decir, todos los vampiros que excluyan a los Arch Vampires (Arch Cónclave) estarán sujetos a este sistema legal.
- La oficina del Devil´s Advocate servirá para interpretar y presentar argumentos ante el Poder Judicial del Arch Cónclave en nombre de aquellos que están presentando un caso contra un individuo o grupo dentro del reino de Progeny. La oficina del Devil´s Advocate y sus asesores no son jueces, son defensores de los acusados y acusadores.
- Para ser claro, el Diabolic Cónclave (Decisiones tomadas como un cuerpo), los actos individuales de un Diabólico, el Arch Cónclave (Decisiones tomadas como un cuerpo) o los actos individuales de un Arch Vampiro, NO caen bajo el ámbito de la Oficina del DEVIL'S ADVOCATE y no puede presentarse ante el PODER JUDICIAL DEL ARCH CÓNCLAVE (Arch Judiciary). Cualquier caso que uno pueda tener contra un Diabólico o Arch Vampiro, o las decisiones tomadas por el Arch Cónclave o el Diabolic Cónclave deben enviarse a través de los canales existentes que se enumeran en su totalidad al final de este documento.
- También se entiende por la aceptación de esta documentación por parte del Arch Cónclave, el Diabolic Cónclave, la Soberanía del Clan y Princeps de Casa (Renegade, Rogue o GCSC) que desde este momento el reino de Progeny está sujeto a este 'sistema legal institucional' a partir de la fecha de su 'aceptación y que la documentación indicada en las secciones' JURISDICCIÓN DEL TRIBUNAL Y LEY APLICABLE ',' LEYES ',' PROCEDIMIENTO JUDICIAL 'y' TÉRMINOS DE REFERENCIA 'serán las fuentes' primarias 'de las cuales la oficina del Poder Judicial del Arch Cónclave y el Devil´s Advocate operarán
- Las determinaciones históricas por cualquier nivel de Progeny que podrían usarse como argumento legal o precedente, se permitirán caso por caso, dependiendo de la fuente del juicio y su relevancia para la situación en cuestión. 5.0 PODER JUDICIAL DEL ARCH CÓNCLAVE
El Sistema Legal Institucional Progeny tendrá un Poder Judicial elegido entre el Arch Cónclave a cargo de Arch Ráicђéal Rírá O'Coηghaile (rachelc) como la primer Presidente del Tribunal Supremo. El Presidente del Tribunal Supremo ocupará el cargo de Juez Magistrado de Primera Instancia y designará al poder judicial asociado según se requiera entre el Arch Cónclave.

7.0 JURISDICCIÓN Y LEY APLICABLE
Por el momento, cada sección de la comunidad de Progeny está sujeta a reglas y leyes dispares que rigen su conducta. La consecuencia de esto es que no todos los casos se juzgan de acuerdo con un código de justicia uniforme. Esto dificulta el proceso de creación de casos contra ciertos miembros de nuestra comunidad en determinadas situaciones.
Para aclarar las leyes que son aplicables a cada sección de nuestra sociedad, las hemos agrupado en 'GCSC alineadas' y 'NO alineadas con GCSC'.
Para simplificar la categorización de los grupos, por ejemplo, bajo la categoría 'GCSC Alineados' hemos agrupado Casas bajo un cierto tipo de Clan como de ese "mismo" tipo, es decir, un Clan Disidente tiene Casas Disidentes y todas están alineadas con GCSC, mientras una Casa Rogue es, por definición, NO alineada con GCSC, independientemente de si de hecho eligen seguir la ley de GCSC.
Este no es siempre el caso, ya que un Clan afiliado al Arch puede tener una Casa de Renegados Políticos, por ejemplo, que es tolerada y permitida por el Clan Soberano. Por decreto diabólico, no importa qué estructura de gobierno interno pueda elegir un soberano de clan para organizar las casas bajo su soberanía, la posición principal del clan será la medida de la cual se probarán las casas.
Tenga en cuenta que si presenta un caso en la oficina del Devil´s Advocate , el primer paso será determinar las afiliaciones de Clan y Casa para comenzar a evaluar el asunto. Si el asunto avanza hasta la etapa de ponerse en contacto con la parte acusada, también deberá proporcionar esta información. Esta información inicial permitirá que el fiscal asignado al caso determine bajo qué ley procederá el asunto.

Las reclamaciones contra un procedimiento de Arch Cónclave deben dirigirse a un Diabólico para que se dirijan al Diabolic Cónclave (ver sección 9.0)
7.3c) DIABOLIC o CAMBION
Las reclamaciones contra un Diabólico o Cambion deben dirigirse al Apeiron (ver sección 9.0)
7.3d) DIABOLIC CONCLAVE
Las reclamaciones contra una decisión del Consejo Diabólico deben dirigirse al Apeiron (consulte la sección 9.0)

Aunque es una extensión de la voluntad de un Diabólico, siguen siendo, no obstante, un vampiro y dentro del redil de la comunidad. Su servicio se mantiene siempre que se justifique la necesidad de su servicio.
También debe tenerse en cuenta que al aceptar una oferta de un Diabólico para convertirse en uno de sus Infernales, el individuo, si bien se ha señalado previamente como una extensión del Diabólico, debe tener en cuenta el hecho de que, a partir de ese momento, lleva y refleja la reputación tanto de ellos mismos como de su Patrón.
